Does placing a child in solitary confinement for prolonged periods of time amount to inhumane and degrading treatment in breach of A3?

Background

A child was placed in solitary confinement for prolonged periods of time in a Youth Offenders Institute.

Why we were involved

It was our view that there should be a rebuttable presumption that prolonged solitary confinement breaches Article 3.

We have long-standing concerns about the increased use of solitary confinement in respect of children especially in youth detention settings.

This case fell within our Core Aim to strengthen human rights laws and under our aim to protecting the rights of the people in the most vulnerable situations.

We intervened in this case at the High Court and Court of Appeal.
